| Consulting A Lawyer Should Be Done ASAP By DePuy Hip Recall Patients | |||||
|
In August of this year, orthopedic device
manufacturer DePuy have recalled about 93,000 units
of their hip replacement devices resulting in
hundreds of victims seeking damages. A design flaw
was said to be found in two of their hip implants
namely ASR XL Acetabular System and ASR Hip
Resurfacing System. As twelve percent of recipients
need to undergo a revision surgery, people have
been wondering about the benefits a legal counsel
would entail. Truth be told, without any legal
help, you are placed in a major disadvantageous
position. Several reasons
that detail why you need the back-up of a hip
recall lawyer are the following: A lawyer is your best bet at getting fair compensation. DePuy Orthopaedics has been claiming to reimburse recipients of medical costs that the product defect caused. You are sure however that their interests come first before anyone else's. A lawyer would take your interests for safekeeping and will ensure that you are justified by straining to provide you with the best chance of compensation. Time may be running out. You might be surprised to find out that the period of time you are allowed to file a lawsuit against DePuy is limited. Statutes of limitations provide you with a certain time frame wherein you could file claims. These statutes differ from each state and consulting with a lawyer immediately could prevent you from being barred from taking legal action. A second medical opinion may be necessary. In 2009, it was found that consultants have received over $50 million from DePuy showing that there exists financial ties between some doctors and the company. Though a lawyer is not eligible to advise you regarding medical conditions, he could brief you with what answers you should expect to get from your surgeon. Evidence-gathering should start immediately. Your lawyer still needs your help in collecting material evidence that could influence the outcome of your lawsuit. Accumulating these as soon as possible is important preventing you from losing them or giving them to the wrong people. If there were any means that DePuy can get away with giving you an amount that is unreasonably small, they will take it. A DePuy hip recall lawyer would broaden your options and would be a significant part in obtaining full reimbursement for your losses. |

| DePuy Knew of Significant Data Before Hip Recall | |||||
|
Following the hip recall of the ASR XL Acetabular
and ASR Hip Resurfacing System by Johnson and
Johnsonsubsidiary DePuy, reports have indicated
that the said orthopedic manufacturer have already
known the5 -year failure rate of the devices. A New
York Times article written in March 2010 disclosed
that monthsbefore DePuy issued a recall of the hip
replacements, they were aware that the ASRs were
failing at adramatic rate. Australian director of an implant database, Dr. Stephen Graves, asserted that the company's plans to phaseout the devices before 2010 ends were too late to curb alarming damages. Unfavorable data have alreadystarted to pile up in Australia, where the hip replacements were sold more extensively than in the UnitedStates. It showed for quite some time that the devices fail earlier than their competitors. Prior to the worldwide hip recall, DePuy have withdrawn the ASRs from the Australian market. In the United States, FDA has received about 300 complaints against the DePuy hip replacements. A component of the device sold separately referred to as an ASR 'cup' did not receive any clinical approval. Initially, complaints were addressed by the company as mistake on the surgeon's part to install the device properly. Subsequently, DePuy sent out letters that warned surgeons that the hip replacements were less effective in people with small stature, specifically women, and people with weak bones. It is apparent that the orthodepic manufacturer has acted too late on the matter. DePuy ASR's defective metal-on-metal makeup cause significant amount of toxic metal debris to be scraped off its parts. The particles affect the surrounding muscles and tissue bringing about swelling, inflammation, pain and in most cases, a costly revision surgery. Typically, a hip replacement device should last for about 15 years. The ASRs last for a third of that. The damages caused by the devices vary among patients. If you are a recipient of a DePuy hip replacement ASR, you need to consult your doctor to undergo a medical evaluation. An appointment with a DePuy hip recall lawyer is important for them to protect your best interests. |
